By visiting our site and/or purchasing something from us, you engage in our “service” and agree to be bound by the following terms and conditions (“Terms of Service," “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Article 1 – General Provisions

3H is a platform on which third parties can offer products to visitors. These third parties are private sellers, who offer their products through the platform.

A customer can proceed to purchase a product via 3H. An agreement is then concluded between the private seller and the customer. 3H acts as an intermediary, an intermediary, and never becomes part of the concluded purchase agreement.

3H is a mediator in concluded purchase agreements between private individuals. The agreements concluded between these private individuals are not consumer purchase agreements within the meaning of art. 7:5 Civil Code. In any case, it is never 3H that concludes (consumer) purchase agreements.

Article 2 – Applicability of General Terms and Conditions

These general terms and conditions apply to the order and purchase of products via 3H.

Every customer who places an order for a product offered by 3H within the environment accepts the applicability of these general terms and conditions.

The provisions of these general terms and conditions can only be deviated from in writing with the consent of the parties involved, in which case the other provisions will remain in full force.

These general terms and conditions apply to both buyers who can be regarded as consumers and buyers to whom this does not apply.

All rights and claims, as stipulated in these general terms and conditions and in any further agreements for the benefit of 3H, are also stipulated for the benefit of the intermediaries and other third parties engaged by 3H, expressly including the private seller(s).

Article 3 – Purchase agreement with private sellers

The customer acknowledges that the purchase agreement is concluded between him or her as a customer and the private seller and that 3H is only an intermediary in this agreement.

In case of questions and/or complaints about the products purchased by the customer via 3H, the customer should turn to 3H. 3H will contact the private seller and make every effort to find a solution.

In the event of a dispute between 3H and the customer about whether or not products have been shipped, 3H will try to find a solution together with the customer. Buyer and private seller are obliged to cooperate in a solution. The customer indemnifies 3H against claims for compensation on account of non-performance by the private seller.

Article 4 – Order and control

A customer can place an order through the normal ordering process at 3H for a product that is offered by a private seller.

3H receives the shoes for the buyer. They carry out a strict authenticity check for the customer. If the shoe is found to be authentic, the shoe is provided with an authenticity label (which is attached to the shoe).

Schoedam.com has years of experience in authenticating shoes. The authenticity label therefore indicates that it could not be determined on the basis of the external characteristics of the shoe that the shoe is not authentic. The buyer indemnifies 3H against claims for compensation on account of the non-authenticity of the shoe, as long as the 3H experts could not reasonably determine this on the basis of the external characteristics of the shoe.

After the shoes have been provided with an authenticity label, they are sent to the customer, or the customer can pick up the shoes at the 3H premises.

If 3H sees any reason, direct or indirect, to doubt the authenticity of the shoes ordered by the customer, it is authorized to dissolve the agreement on behalf of the buyer. 3H will then immediately return the received shoes and refund any payment already received by 3H.

Article 5 – Right of withdrawal excluded, returns not possible

If a customer purchases shoes from a private seller via 3H, the right of withdrawal does not apply. In concrete terms, this means that the buyer cannot return the product. This is because this does not concern a distance purchase (within the meaning of Article 6:230g of the Dutch Civil Code), nor a consumer purchase (within the meaning of Article 7:5 paragraph 1 sub a of the Dutch Civil Code).

Article 6 – Purchase agreement and delivery

The 3H website contains various references to shoes and purchase prices. These shoes can also be paid for at 3H. However, by purchasing the shoes, the buyer is only making an offer to the private seller to buy the shoes for the price shown on the 3H website. In this context, the purchase agreement is only concluded if the private seller accepts this offer. Purchasing shoes on 3H never implies acceptance of an offer.

If a Private Seller does not send an order to 3H within four (4) working days, 3H will inform the customer within six (6) working days after the customer has placed the order that his order has not been shipped and, if applicable, the 3H return payment already received.

Article 7 – Applicable law

These general terms and conditions are exclusively governed by Dutch law. All disputes between the parties will be submitted to the Dutch court.
